{"id":9561,"date":"2021-10-01T00:00:00","date_gmt":"2021-10-01T00:00:00","guid":{"rendered":"https:\/\/www.cinc.com\/penalties-for-non-compliance-with-the-telework-law\/"},"modified":"2021-10-01T00:00:00","modified_gmt":"2021-10-01T00:00:00","slug":"penalties-for-non-compliance-with-the-telework-law","status":"publish","type":"post","link":"https:\/\/www.cinc.com\/en\/penalties-for-non-compliance-with-the-telework-law\/","title":{"rendered":"Penalties for non-compliance with the Telework Law"},"content":{"rendered":"<div style=\"text-align: justify;\">\n\tThe regulation of the sanctioning regime for non-compliance with the teleworking law becomes effective from today, 1rst October 2021.<\/div>\n<div style=\"text-align: justify;\">\n\t&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n\tThe approval of law 10\/2021 of 9 July on teleworking and Royal Decree Law 28\/2020 on teleworking entails modifications to the law on infringements and penalties (LISOS).<\/div>\n<div style=\"text-align: justify;\">\n\t&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n\tThis is a reminder of our <a href=\"https:\/\/www.cinc.com\/es\/noticia\/las-claves-del-real-decreto-ley-28-2020-de-trabajo-a-distancia\" target=\"_blank\" rel=\"noopener\">publication <\/a>of last September 2020 where we informed you of the aspects of the standard that should be highlighted:<\/div>\n<ol>\n<li style=\"text-align: justify;\">\n\t\tVoluntariness and reversibility of teleworking.<\/li>\n<li style=\"text-align: justify;\">\n\t\tIndividual agreement on teleworking.<\/li>\n<li style=\"text-align: justify;\">\n\t\tTeleworking days.<\/li>\n<li style=\"text-align: justify;\">\n\t\tCosts of teleworking.<\/li>\n<li style=\"text-align: justify;\">\n\t\tEqual treatment of workers and teleworkers.<\/li>\n<li style=\"text-align: justify;\">\n\t\tCorporate control.<\/li>\n<li style=\"text-align: justify;\">\n\t\tProvision of equipment.<\/li>\n<li style=\"text-align: justify;\">\n\t\tMinors and training.<\/li>\n<li style=\"text-align: justify;\">\n\t\tWorkers&#39; rights.<\/li>\n<\/ol>\n<div style=\"text-align: justify;\">\n\tWe focus on the second point:<\/div>\n<div style=\"text-align: justify;\">\n\t&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n\t&quot;Individual agreement on remote work&quot; which requires the company to sign a written agreement with each worker within a period of 3 months, which will have to contemplate the specifics derived from the work, which may form part of the employment contract or be made at a later time, but which will have to be formalised before remote work begins and registered with the Employment Office.
