Democratic Memory Law

After months of deliberation in Court, the Law of Democratic Memory, popularly known as the Law of grandchildren, has fin finally approved by the Official State Gazette of Spain on the 20th of October 2022. The new legislation extends the assumptions stipulated from the law approved in Spain in 2007, that is no longer in force, and allows more people form Cuba and Latin America, descendants of Spaniards who were born abroad, to obtain the Spanish nationality directly without having to live in Spain for no minimum period of time. 
 
Although the main aim of the law is to compensate the victims of Spain’s Civil War and the later military government of Francisco Franco, the additional 8th disposition facilitates the obtain of a Spanish passport for three new groups:
 

Requirements to apply


  • Those born outside Spain of father or mother, grandfather or grandmother, that were originally Spanish, and who, as a consequence of exile for political, ideological or religious reasons or for reasons of sexual orientation and identity, have lost or renounced Spanish nationality. 
  • Sons and daughters born abroad from Spanish women who lost their nationality because of their marriage to someone from another country before the Spanish Constitution was effective in 1978.
  • Sons and daughters of legal age of those Spaniards whose nationality of origin was recognized by virtue of the right of option, in accordance with the provisions of the present law, approved in 2007.
 
In all cases, this declaration would have to be formalized within two years of the entry into force of this law.
