{"id":4122,"date":"2022-12-15T00:00:00","date_gmt":"2022-12-15T00:00:00","guid":{"rendered":"https:\/\/www.cinc.com\/projecte-de-llei-datencio-a-la-clientela\/"},"modified":"2022-12-15T00:00:00","modified_gmt":"2022-12-15T00:00:00","slug":"projecte-de-llei-datencio-a-la-clientela","status":"publish","type":"post","link":"https:\/\/www.cinc.com\/ca\/projecte-de-llei-datencio-a-la-clientela\/","title":{"rendered":"Projecte de llei d&#8217;atenci\u00f3 a la clientela"},"content":{"rendered":"<div style=\"text-align: justify;\">\n<div>\n\t\tAquest Projecte de llei t&eacute; per objectiu refor&ccedil;ar els est&agrave;ndards m&iacute;nims per a una prestaci&oacute; efectiva del servei, protegint i ampliant els drets que assisteixen als consumidors.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div style=\"text-align: center;\">\n<h2 class='h2Noticia'> A qui va dirigit? <\/h2>\n<hr\/>\n<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tAquesta normativa ser&agrave; aplicable per a totes les empreses, p&uacute;bliques i privades, que prestin serveis essencials al territori espanyol (com, per exemple, serveis de subministrament i distribuci&oacute; d&#39;aigua, serveis postals, serveis de transport, serveis financers, etc.), aix&iacute; com qualsevol empresa, independentment del sector, amb m&eacute;s de 250 treballadors o amb un volum de negoci superior a 50 milions d&#39;euros.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div style=\"text-align: center;\">\n<h2 class='h2Noticia'> Quins objectius persegueix? <\/h2>\n<hr\/>\n<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<ul>\n<li>\n\t\t\tLes empreses han de disposar d&rsquo;un servei d&rsquo;atenci&oacute; a la clientela gratu&iuml;t, efica&ccedil;, accessible, inclusiu, no discriminatori i avaluable.<\/li>\n<li>\n\t\t\tIndicaci&oacute; dels canals de comunicaci&oacute; disponibles.<\/li>\n<li>\n\t\t\tFacilitar la presentaci&oacute; de queixes, reclamacions, incid&egrave;ncies o consultes.<\/li>\n<li>\n\t\t\tEl termini en qu&egrave; han de ser resoltes les reclamacions ha de ser el m&eacute;s breu possible en funci&oacute; de la naturalesa del problema i, en el termini m&agrave;xim de 15 dies des de la presentaci&oacute;, i en el cas de serveis b&agrave;sics, 2hores.<\/li>\n<li>\n\t\t\tEl temps m&agrave;xim d&#39;espera per a l&#39;usuari des de la recepci&oacute; de la trucada al servei d&#39;atenci&oacute; al client no podr&agrave; superar els tres minuts per a m&eacute;s del 90 per 100 de les trucades al servei d&#39;atenci&oacute; al client.<\/li>\n<li>\n\t\t\tL&#39;empresa haur&agrave; d&#39;indicar els sistemes de resoluci&oacute; extrajudicial de conflictes a qu&egrave; la clientela pot tenir acc&eacute;s i com hi pot accedir.<\/li>\n<\/ul>\n<div>\n\t\t&nbsp;<\/div>\n<div style=\"text-align: center;\">\n<h2 class='h2Noticia'>Principals novetats<\/h2>\n<hr\/>\n<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<ul>\n<li>\n\t\t\tL&acute;horari del servei d&acute;atenci&oacute; a la clientela s&acute;ajustar&agrave; a l&rsquo;horari comercial de l&acute;empresa. Per a serveis de car&agrave;cter b&agrave;sic, com ara el servei telef&ograve;nic, el subministrament el&egrave;ctric, de gas o d&#39;aigua, el servei haur&agrave; d&#39;estar disponible 24 hores, els 365 dies a l&#39;any.<\/li>\n<li>\n\t\t\tS&#39;ha de facilitar una atenci&oacute; personalitzada, tot prohibint l&#39;&uacute;s de contestadors autom&agrave;tics.<\/li>\n<li>\n\t\t\tEs prohibeix la utilitzaci&oacute; de n&uacute;meros de tarifaci&oacute; addicional com a mitj&agrave; de comunicaci&oacute; amb els clients, ja sigui via telef&ograve;nica, mitjan&ccedil;ant missatges de text o altres an&agrave;legs.<\/li>\n<\/ul>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tLes infraccions lleus de les previsions de la llei poden comportar la imposici&oacute; de sancions de 150 a 10.000&euro; o de 2 a 4 vegades el benefici il&middot;l&iacute;cit realitzat.
