{"id":3599,"date":"2021-10-01T00:00:00","date_gmt":"2021-10-01T00:00:00","guid":{"rendered":"https:\/\/www.cinc.com\/sancions-per-incompliment-de-la-llei-del-teletreball\/"},"modified":"2021-10-01T00:00:00","modified_gmt":"2021-10-01T00:00:00","slug":"sancions-per-incompliment-de-la-llei-del-teletreball","status":"publish","type":"post","link":"https:\/\/www.cinc.com\/ca\/sancions-per-incompliment-de-la-llei-del-teletreball\/","title":{"rendered":"Sancions per incompliment de la llei del teletreball"},"content":{"rendered":"<div style=\"text-align: justify;\">\n\tLa normativa del r&egrave;gim sancionador per incompliment de la llei del teletreball es fa efectiva des d&rsquo;avui, 1 d&rsquo;octubre del 2021.<\/div>\n<div style=\"text-align: justify;\">\n\t&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n\tL&rsquo;aprovaci&oacute; de la llei 10\/2021 de 9 de juliol relativa al teletreball i Reial Decret-Llei 28\/2020, de Treball a dist&agrave;ncia, comporta modificacions en la llei d&rsquo;infraccions i Sancions&nbsp; (LISOS).&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n\t&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n\tFem recordatori de la nostra <a href=\"https:\/\/www.cinc.com\/es\/noticia\/las-claves-del-real-decreto-ley-28-2020-de-trabajo-a-distancia\" target=\"_blank\" rel=\"noopener\">publicaci&oacute;<\/a> del passat setembre 2020 on us inform&agrave;vem dels aspectes que cal destacar de la norma:<\/div>\n<div style=\"text-align: justify;\">\n\t&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n\t1.<span style=\"white-space:pre\"> <\/span>Voluntarietat i reversibilitat el teletreball.<\/div>\n<div style=\"text-align: justify;\">\n\t2.<span style=\"white-space:pre\"> <\/span>Acord individual de la feina a dist&agrave;ncia.<\/div>\n<div style=\"text-align: justify;\">\n\t3.<span style=\"white-space:pre\"> <\/span>Dies de teletreball.<\/div>\n<div style=\"text-align: justify;\">\n\t4.<span style=\"white-space:pre\"> <\/span>Costos del teletreball.<\/div>\n<div style=\"text-align: justify;\">\n\t5.<span style=\"white-space:pre\"> <\/span>Igualtat de tracte entre treballadors i teletreballadores .<\/div>\n<div style=\"text-align: justify;\">\n\t6.<span style=\"white-space:pre\"> <\/span>Control empresarial.<\/div>\n<div style=\"text-align: justify;\">\n\t7.<span style=\"white-space:pre\"> <\/span>Dotaci&oacute; d&#39;equips.<\/div>\n<div style=\"text-align: justify;\">\n\t8.<span style=\"white-space:pre\"> <\/span>Menors i formaci&oacute;.<\/div>\n<div style=\"text-align: justify;\">\n\t9.<span style=\"white-space:pre\"> <\/span>Drets dels treballadors.<\/div>\n<div style=\"text-align: justify;\">\n\t&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n\tPosem focus al segon punt:<\/div>\n<div style=\"text-align: justify;\">\n\t&nbsp;<\/div>\n<div style=\"text-align: justify;\">\n\t&ldquo;Acord individual de la feina a dist&agrave;ncia&rdquo; que exigeix que l&#39;empresa signi amb cada treballador en un termini de 3 mesos un acord per escrit que haur&agrave; de contemplar les especificitats derivades de la feina, que podr&agrave; formar part del contracte laboral o realitzar-se en un moment posterior, per&ograve; que haur&agrave; de formalitzar-se abans que s&#39;inici&iuml; el treball a dist&agrave;ncia i registrar-se a l&#39;Oficina d&#39;Ocupaci&oacute;.
