{"id":31305,"date":"2025-08-12T10:53:33","date_gmt":"2025-08-12T09:53:33","guid":{"rendered":"https:\/\/www.cinc.com\/?p=31305"},"modified":"2025-08-12T10:54:28","modified_gmt":"2025-08-12T09:54:28","slug":"procediment-masc-obligatori-per-als-grans-tenidors-abans-dinterposar-una-demanda-per-conflictes-de-lloguer","status":"publish","type":"post","link":"https:\/\/www.cinc.com\/ca\/procediment-masc-obligatori-per-als-grans-tenidors-abans-dinterposar-una-demanda-per-conflictes-de-lloguer\/","title":{"rendered":"Procediment MASC: obligatori per als grans tenidors abans d\u2019interposar una demanda per conflictes de lloguer"},"content":{"rendered":"\n<p>Amb l\u2019entrada en vigor de la Llei 12\/2023 pel dret a l\u2019habitatge, els grans tenidors \u2014com ara propietaris amb m\u00e9s de 5 habitatges en zona tensionada a Catalunya\u2014 tenen l\u2019obligaci\u00f3 d\u2019iniciar un procediment de resoluci\u00f3 alternativa de conflictes (MASC) abans de poder presentar una demanda judicial contra un llogater, ja sigui per impagament o per altres motius.<br><\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-ef6f3aff\"><h2 class=\"uagb-heading-text\">Qu\u00e8 \u00e9s el procediment MASC?<\/h2><\/div>\n\n\n\n<p>El MASC \u00e9s un mecanisme previ de mediaci\u00f3, conciliaci\u00f3 o arbitratge que pret\u00e9n resoldre el conflicte entre arrendador i arrendatari sense haver de rec\u00f3rrer a la via judicial. A Catalunya, \u00e9s requisit previ per admetre a tr\u00e0mit una demanda de desnonament o reclamaci\u00f3 judicial, sempre que el propietari sigui considerat gran tenidor.<\/p>\n\n\n\n<p>Aquest procediment pot comportar una demora significativa en l\u2019inici del procediment judicial, especialment en casos en qu\u00e8 el llogater no respon a la proposta o no assisteix a la mediaci\u00f3. Tot i que no hi ha un termini legal \u00fanic, es calcula que aquesta fase pot afegir fins a 3 mesos d\u2019espera abans de poder interposar la demanda.<br><\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-2835626d\"><h2 class=\"uagb-heading-text\">Qu\u00e8 s\u2019ent\u00e9n per \u201cgran tenidor\u201d?<\/h2><\/div>\n\n\n\n<p>Segons la normativa actual, un gran tenidor \u00e9s una persona f\u00edsica o jur\u00eddica que posseeix m\u00e9s de 10 immobles d\u2019\u00fas residencial o una superf\u00edcie constru\u00efda de m\u00e9s de 1.500 m\u00b2, exclosos garatges i trasters. No obstant aix\u00f2, en zones tensionades a Catalunya, aquest llindar es redueix a m\u00e9s de 5 immobles. Aquesta classificaci\u00f3 afecta directament a l\u2019aplicaci\u00f3 de la Llei pel dret a l\u2019habitatge i, per tant, a l\u2019obligaci\u00f3 de seguir el procediment MASC.<br><\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-1206b9e2\"><h2 class=\"uagb-heading-text\">Com protegir-se davant aquesta nova obligaci\u00f3?<\/h2><\/div>\n\n\n\n<p>Aquesta obligaci\u00f3 suposa una c\u00e0rrega afegida per als grans tenidors, tant pel que fa a terminis com a despeses legals, i pot comportar p\u00e8rdues econ\u00f2miques importants si no es compta amb la protecci\u00f3 adequada.<\/p>\n\n\n\n<p>Des de CINC Corredoria de Seguros t\u2019informem que disposem de dues solucions asseguradores adaptades a aquesta nova realitat:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Una p\u00f2lissa de defensa i reclamaci\u00f3 jur\u00eddica per a propietaris que cobreix les despeses legals relacionades amb conflictes de lloguer.<\/li>\n\n\n\n<li>Una p\u00f2lissa completa que inclou defensa jur\u00eddica, vandalisme, i p\u00e8rdua de lloguers fins a 15 mesos (incloent-hi el per\u00edode que pot durar el MASC).<br><\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-8a20bd90\"><h2 class=\"uagb-heading-text\">Ets gran tenidor i no saps com actuar?<\/h2><\/div>\n\n\n\n<p>A CINC Corredoria de Seguros t\u2019assessorem perqu\u00e8 disposis de la cobertura adequada segons el teu perfil com a arrendador.
