Ara, aquesta situaci\u00f3 no implica l\u2019extinci\u00f3 autom\u00e0tica del contracte, sin\u00f3 que es prioritza l\u2019adaptaci\u00f3 i la continu\u00eftat laboral.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-57130e85\"><h2 class=\"uagb-heading-text\">Quan pot aplicar-se l\u2019extinci\u00f3 del contracte?<\/h2><\/div>\n\n\n\n<p>Nom\u00e9s en els seg\u00fcents sup\u00f2sits:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Quan no \u00e9s possible fer ajustos raonables al lloc de treball de la persona afectada.<\/li>\n\n\n\n<li>Quan no es pot recol\u00b7locar la persona en un altre lloc adequat dins l\u2019empresa per: manca de vacants, manca de formaci\u00f3 per accedir a una vacant disponible, o rebuig expr\u00e9s de la persona treballadora a la recol\u00b7locaci\u00f3 proposada.<br><\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-257add4b\"><h2 class=\"uagb-heading-text\">Qu\u00e8 s\u2019ent\u00e9n per &#8220;ajustos raonables&#8221;?<\/h2><\/div>\n\n\n\n<p>S\u00f3n modificacions o adaptacions que permetin a la persona treballadora seguir prestant serveis sense suposar una c\u00e0rrega excessiva per a l\u2019empresa.<br><\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-b7d0f876\"><h2 class=\"uagb-heading-text\">Quan es considera que hi ha c\u00e0rrega excessiva?<\/h2><\/div>\n\n\n\n<p>S\u2019haur\u00e0 de valorar cas per cas, tenint en compte:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El cost de l\u2019adaptaci\u00f3.<\/li>\n\n\n\n<li>La mida i recursos de l\u2019empresa.<\/li>\n\n\n\n<li>Si l\u2019empresa rep ajudes o subvencions per fer l\u2019adaptaci\u00f3.<\/li>\n<\/ul>\n\n\n\n<p>En empreses amb menys de 25 persones treballadores, es considera que hi ha una c\u00e0rrega excessiva si l\u2019adaptaci\u00f3 suposa un cost superior a:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La indemnitzaci\u00f3 per acomiadament improcedent<\/li>\n\n\n\n<li>Sis mesos de salari de la persona treballadora afectada.<br><\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-62ed679f\"><h2 class=\"uagb-heading-text\">Quins s\u00f3n els terminis del nou procediment?<\/h2><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>La persona treballadora t\u00e9 10 dies h\u00e0bils per manifestar la seva voluntat de continuar en l\u2019empresa despr\u00e9s del reconeixement de la incapacitat.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u2019empresa disposa de 3 mesos per adaptar el lloc de treball, o oferir una vacant adequada per a la recol\u00b7locaci\u00f3.<\/li>\n\n\n\n<li>Durant aquest termini, el contracte es mant\u00e9 en suspens.<br><\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-a900a2d6\"><h2 class=\"uagb-heading-text\">Qu\u00e8 passa si es pot adaptar el lloc o hi ha una vacant adequada?<\/h2><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Si s\u2019accepta l\u2019adaptaci\u00f3 o la recol\u00b7locaci\u00f3, es repr\u00e8n la relaci\u00f3 laboral i la prestaci\u00f3 per incapacitat permanent es susp\u00e8n.<\/li>\n\n\n\n<li>El retorn al treball ha d&#8217;estar coordinat amb el servei de prevenci\u00f3 ali\u00e8.<\/li>\n\n\n\n<li>Tamb\u00e9 hi ha d\u2019intervenir, si escau, la representaci\u00f3 legal de les persones treballadores en mat\u00e8ria de prevenci\u00f3 de riscos laborals.<br><\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading uagb-block-0541d20e\"><h2 class=\"uagb-heading-text\">Tens dubtes sobre com aplicar aquesta nova normativa a la teva empresa?<\/h2><\/div>\n\n\n\n<p>Des del Departament laboral de CINC Assessoria, estem al teu costat per analitzar la situaci\u00f3 concreta, assessorar-te en mat\u00e8ria d\u2019adaptaci\u00f3 o recol\u00b7locaci\u00f3 i garantir que compleixes amb tots els requisits legals.
