En aquest escrit es recomana a les empreses que estiguin aplicant expedients de regulaci&oacute; temporal d&#39;ocupaci&oacute; (ERTOs) la reducci&oacute; progressiva d&#39;aquestes suspensions per a tota o part de la plantilla cap a la conversi&oacute; en reducci&oacute; de jornada, a mesura que vagin desapareixent les raons vinculades a la for&ccedil;a major.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tEl criteri recorda que la definici&oacute; concreta de les causes objectives que integren la for&ccedil;a major per coronavirus, recollida en el Reial Decret Llei 463\/2020, de 14 de mar&ccedil;, pel qual es va declarar l&#39;estat d&#39;alarma, respon a una causa &quot;externa i perempt&ograve;ria, els efectes i &agrave;mbits concrets dels quals s&oacute;n decidits en cada moment per les autoritats competents per raons de salut p&uacute;blica &quot;. A m&eacute;s, afegeix que &quot;t&eacute; com a conseq&uuml;&egrave;ncia que les diferents mesures puguin ser aplicades amb una intensitat i graduaci&oacute; gradual i diferenciada&quot;.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tEn la situaci&oacute; de desconfinament actual, en cas que una empresa que renunci&iuml; de manera total o parcial a l&#39;ERTO de suspensi&oacute; o el vulgui transformar en reducci&oacute; de jornada, &quot;les exig&egrave;ncies documentals i de procediment han de ser les imprescindibles, i&quot; n&#39;hi haur&agrave; prou amb comunicar a l&#39;autoritat laboral la ren&uacute;ncia a la mesura autoritzada o comunicada, davant d&#39;una recuperaci&oacute; de l&#39;activitat &quot;.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tAix&iacute; mateix, l&#39;empresa haur&agrave; de traslladar a l&#39;entitat gestora de les prestacions &quot;la situaci&oacute; d&#39;afecci&oacute; i desafecci&oacute; de cada un dels treballadors, de manera que el ERTO serveixi per garantir un tr&agrave;nsit no traum&agrave;tic cap a una normalitat futura en la qual les mesures conjunturals hagin deixat de ser necess&agrave;ries &quot;.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tEn definitiva, aquest criteri posa &egrave;mfasi en flexibilitzar i agilitzar els mecanismes per protegir l&#39;ocupaci&oacute; i que les empreses puguin reprendre la seva activitat al m&eacute;s aviat possible.<\/div>\n<\/div>\n<p>\n\t&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p style=\"text-align: justify;\">\n\tEl Ministeri de Treball i Economia Social ha publicat un criteri sobre l&#39;aplicaci&oacute; de mesures de suspensi&oacute; i reducci&oacute; de jornada.
