Segons la resoluci\u00f3, les empreses estan obligades a obrir un expedient previ abans de dur a terme un acomiadament d\u2019aquest tipus, garantint al treballador la possibilitat de presentar al\u00b7legacions i defensar-se. Aquest canvi s\u2019alinea amb els est\u00e0ndards internacionals de l\u2019OIT i la normativa europea, que fins ara no s\u2019havien integrat plenament a la legislaci\u00f3 espanyola.<\/p>\n\n\n\n<p>La q\u00fcesti\u00f3 va prendre rellev\u00e0ncia amb un cas del Tribunal Superior de Just\u00edcia de les Balears, on es va dictaminar que l\u2019ocupador no havia respectat el dret del treballador a defensar-se abans de finalitzar la relaci\u00f3 laboral. Aquest fet va impulsar el Suprem a revisar el compliment del Conveni 158 de l\u2019OIT a Espanya, establint que la seva aplicaci\u00f3 directa \u00e9s \u201cclara i incontestable\u201d. Anteriorment, aquest principi estava limitat a representants sindicals i casos previstos en convenis col\u00b7lectius, per\u00f2 ara s\u2019est\u00e9n a tots els acomiadaments disciplinaris des de l\u2019emissi\u00f3 d\u2019aquesta sent\u00e8ncia.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A quins tipus d&#8217;acomiadament afecta aquesta mesura?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>La nova obligaci\u00f3 s\u2019aplica \u00fanicament als acomiadaments disciplinaris realitzats a partir de la publicaci\u00f3 de la sent\u00e8ncia. En queden exclosos els acomiadaments objectius (basats en causes econ\u00f2miques, t\u00e8cniques o organitzatives) i els disciplinaris efectuats abans d\u2019aquest pronunciament judicial.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quin impacte t\u00e9 aquesta nova obligaci\u00f3 per a les empreses?<\/h2>\n\n\n\n<p><\/p>\n\n\n\n<p>Aquesta sent\u00e8ncia obliga les empreses a revisar els seus procediments interns de gesti\u00f3 disciplin\u00e0ria. Garantir el dret del treballador a rebatre les acusacions no nom\u00e9s \u00e9s una obligaci\u00f3 legal, sin\u00f3 que tamb\u00e9 refor\u00e7a la transpar\u00e8ncia i l\u2019equitat en les relacions laborals, reduint el risc de litigis futurs.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quines conseq\u00fc\u00e8ncies comporta l\u2019incompliment d\u2019aquest tr\u00e0mit?<\/h2>\n\n\n\n<p>L\u2019incompliment d\u2019aquesta formalitat podria derivar en la declaraci\u00f3 d\u2019improced\u00e8ncia de l&#8217;acomiadament per defecte de forma.
