{"id":2705,"date":"2020-04-01T00:00:00","date_gmt":"2020-04-01T00:00:00","guid":{"rendered":"https:\/\/www.cinc.com\/covid-19-suspensio-del-pagament-de-prestecs-sense-garantia-hipotecaria\/"},"modified":"2020-04-01T00:00:00","modified_gmt":"2020-04-01T00:00:00","slug":"covid-19-suspensio-del-pagament-de-prestecs-sense-garantia-hipotecaria","status":"publish","type":"post","link":"https:\/\/www.cinc.com\/ca\/covid-19-suspensio-del-pagament-de-prestecs-sense-garantia-hipotecaria\/","title":{"rendered":"COVID-19: Suspensi\u00f3 del pagament de pr\u00e9stecs sense garantia hipotec\u00e0ria"},"content":{"rendered":"<div style=\"text-align: justify;\">\n<div>\n\t\tAmb efectes des del 2 d&#39;abril de 2020, s&#39;aproven les seg&uuml;ents mesures per suspendre el pagament de pr&eacute;stecs i cr&egrave;dits sense garantia hipotec&agrave;ria.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\t<strong>En qu&egrave; consisteix la suspensi&oacute; del pagament dels pr&eacute;stecs sense garantia hipotec&agrave;ria?<\/strong><\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tS&#39;estableix la suspensi&oacute; temporal del pagament de tot pr&eacute;stec o cr&egrave;dit sense garantia hipotec&agrave;ria que estigu&eacute;s vigent a data de l&rsquo;1 d&#39;abril de 2020.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tLa suspensi&oacute; tindr&agrave; una durada inicial de tres mesos, ampliables pel Consell de Ministres, durant el qual no es podr&agrave; exigir el pagament, no es meriten interessos de cap tipus i la data de venciment del contracte de cr&egrave;dit s&#39;ampliar&agrave; pel temps que duri la suspensi&oacute;.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\t<strong>Qui pot acollir-se a aquesta suspensi&oacute;?<\/strong><\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tEl deutor ha de ser una persona f&iacute;sica que es trobi en situaci&oacute; de vulnerabilitat econ&ograve;mica com a conseq&uuml;&egrave;ncia de la crisi sanit&agrave;ria provocada pel COVID-19. Aquestes mateixes mesures tamb&eacute; s&#39;apliquen als fiadors i avaladors del deutor principal.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tAls efectes de les presents mesures, s&#39;ent&eacute;n per situaci&oacute; de vulnerabilitat social o econ&ograve;mica com a conseq&uuml;&egrave;ncia dels efectes de l&#39;expansi&oacute; de l&#39;COVID-19 aquelles persones que es troben en la seg&uuml;ent situaci&oacute;:<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\t1. Que el deutor passi a estar en situaci&oacute; d&#39;atur.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\t2. Si &eacute;s el deutor empresari o professional (aut&ograve;nom), que hagi sofert una p&egrave;rdua substancial dels seus ingressos o caiguda de facturaci&oacute; de al menys el 40%.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\t3. Que el conjunt dels ingressos de tots els membres de la unitat familiar no superi, en el mes anterior a la sol&middot;licitud, amb car&agrave;cter general 3 vegades IPREM, &eacute;s a dir, 1.613,52 euros (aquest import s&#39;incrementar&agrave; en cas de fills i persones amb discapacitat).<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\t4. Que el total de les quotes hipotec&agrave;ries sobre b&eacute;ns immobles m&eacute;s els subministraments b&agrave;sics, resulti superior a l 35% dels ingressos nets del conjunt de membres de la unitat familiar.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\t5. Que com a conseq&uuml;&egrave;ncia de la crisi del COVID-19, la unitat familiar hagi sofert una alteraci&oacute; de les seves circumst&agrave;ncies en termes d&#39;esfor&ccedil; d&#39;acc&eacute;s a l&#39;habitatge. S&#39;ent&eacute;n que &eacute;s aix&iacute; quan la suma de les quotes hipotec&agrave;ries sobre la renda familiar s&#39;hagi multiplicat per almenys el 1,3.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\t6. Si el deutor no tingu&eacute;s deutes hipotecaris, se substituir&agrave; l&#39;import del deute hipotecari per la suma de la renda mensual de lloguer del seu habitatge m&eacute;s pagaments mensuals per un altre tipus de finan&ccedil;ament.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\t<strong>Com s&#39;aplica?<\/strong><\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tLa suspensi&oacute; ha de sol&middot;licitar-la el prestatari al creditor i el termini de sol&middot;licitud compr&egrave;n des del 2 d&#39;abril de 2020 fins un mes despr&eacute;s de la finalitzaci&oacute; de l&#39;estat d&#39;alarma.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tLa sol&middot;licitud ha d&#39;anar acompanyada de la documentaci&oacute; justificativa de la situaci&oacute; de vulnerabilitat.<\/div>\n<div>\n\t\t&nbsp;<\/div>\n<div>\n\t\tDe complir-se amb els requisits de vulnerabilitat del deutor, el creditor suspendr&agrave; autom&agrave;ticament (sense necessitat d&#39;acord entre les parts) les obligacions de pagament, amb efectes des de la data de sol&middot;licitud.
