Aquestes eines estan oferint millores significatives en la seguretat i el control d&#8217;acc\u00e9s, facilitant la gesti\u00f3 de la jornada laboral dels empleats, aix\u00ed com dels possibles fraus que puguin apar\u00e8ixer.<\/p>\n\n\n\n<p>No obstant aix\u00f2, el fitxatge dels treballadors mitjan\u00e7ant l&#8217;\u00fas d&#8217;aquests sistemes no est\u00e0 exempt de controv\u00e8rsia, pel seu potencial per a realitzar una vigil\u00e0ncia massiva en entorns p\u00fablics. Per aquest motiu, l&#8217;Ag\u00e8ncia Espanyola de Protecci\u00f3 de Dades (AEPD) ha publicat una <a href=\"https:\/\/www.aepd.es\/documento\/guia-control-presencia-biometrico.pdf\">Guia sobre tractaments de control de pres\u00e8ncia mitjan\u00e7ant sistemes biom\u00e8trics<\/a> dirigida a aquelles empreses que utilitzin tecnologia biom\u00e8trica en les seves instal\u00b7lacions per a controlar la pres\u00e8ncia dels seus empleats.<\/p>\n\n\n\n<p>A continuaci\u00f3, resumim quines s\u00f3n les recomanacions principals:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Principi de minimitzaci\u00f3 de dades del RGPD: nom\u00e9s tractar aquells estrictament necessaris.<\/li>\n\n\n\n<li>Base leg\u00edtima: no utilitzar dades biom\u00e8triques tret que es doni un cas d&#8217;obligaci\u00f3 laboral prescrita per la llei nacional, el Dret de la UE o un conveni col\u00b7lectiu.<\/li>\n\n\n\n<li>Avaluar l&#8217;impacte generat despr\u00e9s de l&#8217;an\u00e0lisi de les dades obtingudes.<\/li>\n\n\n\n<li>Oferir garanties organitzatives, t\u00e8cniques i jur\u00eddiques.<\/li>\n\n\n\n<li>En cas d&#8217;implementar accions amb Intel\u00b7lig\u00e8ncia Artificial, tenir en compte les seves limitacions i exig\u00e8ncies.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Q\u00fcestions controvertides<\/h2>\n\n\n\n<p>El nou criteri de l&#8217;AEPD ha generat incertesa entre els experts, els qui q\u00fcestionen si el tractament de dades biom\u00e8triques seria legal sota un conveni col\u00b7lectiu detallat o altres sistemes alternatius. A m\u00e9s, la guia s&#8217;enfronta a interpretacions judicials pr\u00e8vies, com la validesa del reconeixement facial segons una decisi\u00f3 del Tribunal Superior de Just\u00edcia de Madrid, o l&#8217;acceptaci\u00f3 d&#8217;un sistema de control horari biom\u00e8tric per part del Tribunal Suprem en 2007.
