{"id":22132,"date":"2024-01-23T10:29:44","date_gmt":"2024-01-23T09:29:44","guid":{"rendered":"https:\/\/www.cinc.com\/?p=22132"},"modified":"2024-01-25T09:30:42","modified_gmt":"2024-01-25T08:30:42","slug":"reclamacio-despeses-hipotecaries-anteriors-al-2019","status":"publish","type":"post","link":"https:\/\/www.cinc.com\/ca\/reclamacio-despeses-hipotecaries-anteriors-al-2019\/","title":{"rendered":"Reclamaci\u00f3 de despeses hipotec\u00e0ries anteriors al 2019"},"content":{"rendered":"\n<p>Si vas formalitzar el teu pr\u00e9stec hipotecari abans del 2019, encara est\u00e0s a temps de reclamar algunes de les despeses hipotecaries assumides al moment de la formalitzaci\u00f3.<\/p>\n\n\n\n<p>El Tribunal Suprem, va sentenciar <strong>que les entitats bancaries aplicaven cl\u00e0usules abusives, no negociades amb el consumidor<\/strong>, en les que imposaven a aquests \u00faltims el pagament de les despeses associades al pr\u00e9stec hipotecari.<\/p>\n\n\n\n<p>En conseq\u00fc\u00e8ncia, arrel del pronunciament del Tribunal Suprem, els consumidors podien sol\u00b7licitar al banc la devoluci\u00f3 d\u2019aquests despeses assumides indegudament. Es calcula que es pot reclamar uns 800-1.000 euros de mitjana en funci\u00f3 de la quantia del pr\u00e9stec formalitzat.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Quines despeses hipotec\u00e0ries es poden reclamar?<\/h3>\n\n\n\n<p>Les despeses que hauria d\u2019haver assumit l\u2019entitat banc\u00e0ria s\u00f3n les seg\u00fcents:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>El 50% de les&nbsp;despeses notarials, ja que l&#8217;altra meitat l&#8217;ha d&#8217;assumir els deutors.&nbsp;<\/li>\n\n\n\n<li>El 100% de les despeses pagades de registre de la propietat.<\/li>\n\n\n\n<li>El 100% dels honoraris corresponents a la&nbsp;gestoria.<\/li>\n\n\n\n<li>El 100% dels costos pagats per a la&nbsp;taxaci\u00f3 de l\u2019immoble.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Quin termini tens per reclamar?<\/h3>\n\n\n\n<p>\u00c9s un tema dif\u00edcil de respondre amb exactitud, ja que la data de finalitzaci\u00f3 del termini per reclamar no ha quedat del tot determinada.<\/p>\n\n\n\n<p>La q\u00fcesti\u00f3 ha estat elevada al Tribunal Europeu de Drets Humans per tal que es pronunci\u00ef sobre la data de finalitzaci\u00f3 del per\u00edode de reclamaci\u00f3 ja que el dubte est\u00e0 en el moment en que s\u2019inicia el dret de reclamar.<\/p>\n\n\n\n<p>Fins que l\u2019anterior no succeeixi, <strong>el termini m\u00e0xim per presentar reclamacions de despeses hipotecaries finalitzaria el 23 de gener de 2024<\/strong>, 5 anys despr\u00e9s de la sent\u00e8ncia del Tribunal Suprem que es pronunciava sobre la nul\u00b7litat d\u2019aquesta cl\u00e0usula i determinava els costos a assumir per cada part: entitat banc\u00e0ria i consumidor.<\/p>\n\n\n\n<p>En el nostre cas, a l\u2019\u00e0mbit de les hipoteques formalitzades a Catalunya, on resulta d\u2019aplicaci\u00f3 el Codi Civil Catal\u00e0 es podria considerar que el termini de prescripci\u00f3 de l\u2019acci\u00f3 de reclamaci\u00f3 seria de 10 anys i no de 5 anys com contempla el Codi Civil espanyol.
